Terms & Conditions

1. Overview
These Terms & Conditions govern bookings made through benittrentals.com for properties managed by Benitt Rentals, operated by Normanton Way LLC (“Host,” “we,” or “us”). By submitting a booking request or payment, you (“Guest”) agree to these terms in full.
2. Booking Process
We offer three properties with different booking flows:
- San Diego Oasis — Instant Book available. Payment is charged immediately upon confirmation. The reservation is confirmed when payment succeeds.
- Park City Canyons — Request to Book. Your card is authorized (not charged) when you submit. The host reviews your request and accepts or declines within 24 hours.
- NYC Central Park — Request to Book with HOA approval required. Same authorization hold process as above, plus a board approval step. The management company’s review takes up to 7 business days once all documents are fully submitted, followed by the board’s own review period. Your dates are tentatively held during this process.
All bookings require acceptance of the House Rules before any payment is processed.
3. Payment Terms
- Instant Book: The full amount (including all taxes and fees as shown at checkout) is charged at the time of booking.
- Request to Book: Your card is authorized for the full amount. No charge is made until the host accepts. If declined, the authorization is released within 5–7 business days depending on your bank.
- All prices are in USD and include applicable taxes and cleaning fees as quoted. Rates are subject to Beyond Pricing dynamic adjustments and are confirmed at the time of booking.
- Payment is processed securely by Stripe. We never store your full card details.
4. Cancellation Policy
Cancellation terms differ by property. Please review the applicable policy before booking. Questions? Contact us.
- San Diego Oasis — Cancel more than 30 days before check-in for a full refund. Cancel 7–30 days before check-in for a 50% refund of nightly costs. Cancellations within 7 days of check-in are non-refundable.
- NYC Central Park — Free cancellation within 48 hours of booking. After that, the reservation is non-refundable.
- Park City Canyons — Cancel more than 30 days before check-in for a full refund. Cancel 7–30 days before check-in for a 50% refund of nightly costs. Cancellations within 7 days of check-in are non-refundable.
5. House Rules
By completing your booking, you agree to the following house rules:
- No smoking within 25 feet of the property.
- No parties or events of any kind.
- No extra guests beyond the number listed in your reservation.
- Be respectful of neighbors — keep noise to a reasonable level at all times.
- Quiet hours are strictly observed from 10 PM to 8 AM.
- Check-in and check-out times must be respected (see property page for specifics).
- Guests are responsible for any damage caused during their stay.
Violation of house rules may result in immediate termination of the stay without refund and/or charges for damages.
6. HOA Approval (NYC Property)
The NYC Central Park property is subject to approval by the building’s Homeowners Association (HOA). By submitting a request for this property, you acknowledge that:
- Your booking is not confirmed until HOA approval is granted.
- The management company’s review takes up to 7 business days once all documents are fully submitted, followed by the board’s own review period.
- Application fees (approximately $1,000 per application) are paid directly to the building and are non-refundable. Incomplete submissions incur a $200 resubmission fee.
- If HOA approval is denied, your card authorization for rental fees will be released in full. Application fees paid to the building are not refunded.
- You agree to complete any required HOA documentation promptly upon request.
7. Guest Responsibilities
As a guest, you are responsible for:
- Leaving the property in the same condition as you found it.
- Reporting any damage or maintenance issues promptly.
- Ensuring all members of your group comply with house rules.
- Providing accurate information during the booking process.
8. Limitation of Liability
To the fullest extent permitted by law, Benitt Rentals shall not be liable for any indirect, incidental, or consequential damages arising from your use of our properties or website. Our total liability for any claim shall not exceed the total amount paid for the booking in question.
We are not responsible for: acts of nature, force majeure events, actions of third parties, or circumstances outside our reasonable control that affect your stay.
9. Governing Law
These terms are governed by the laws of the state in which the booked property is located (California for San Diego, Utah for Park City, New York for NYC), without regard to conflict of law principles.
10. SMS/Text Messaging
Benitt Rentals may send you SMS text messages containing property information, booking links, or reservation-related updates. By verbally requesting a text message during a phone call with our AI voice assistant or staff, you consent to receive SMS messages at the phone number you provide.
- Opt-in: Consent is obtained verbally during a phone call with our business line, which is answered by our AI voice assistant or staff. When you call our business and request that we text you property information or a booking link, we will confirm your phone number and inform you that message and data rates may apply and that you can reply STOP at any time.
- Message frequency: Message frequency varies. You will only receive messages relevant to your specific request or reservation.
- Opt-out: You may opt out at any time by replying STOP to any message. You will receive a single confirmation message and no further texts will be sent. You may also contact us at info@benittrentals.com to opt out.
- Help: Reply HELP to any message for assistance, or contact us at info@benittrentals.com.
- Cost: Message and data rates may apply depending on your mobile carrier and plan.
- Carriers: Carriers are not liable for delayed or undelivered messages.
- We do not sell, rent, or share phone numbers or SMS consent with third parties for their marketing purposes.
11. Changes to These Terms
We may update these Terms & Conditions from time to time. The version in effect at the time of your booking applies to that booking. Material changes will be reflected with an updated effective date.
